Peruvian government expects Telefónica subsidiary to immediately pay debt of US$ 262 million

José Arista, head of the Economy and Finance portfolio, says that they are looking to accelerate processes in the Tax Court for tax controversies.

The Minister of Economy and Finance of Peru, José Arista, indicated today that the debt of the national subsidiary of Telefónica with the Peruvian State, for more than 1,000 million soles (US$ 262 million), already has to be collected immediately.

“The collection already has to be executed because they are letters of guarantee. The debt that must be collected from Telefónica exceeds 1,000 million soles (US$ 262 million),” he indicated on TV Perú .

It should be noted that, after a long controversy of almost 20 years initiated by the taxpayer Telefónica de Perú, the Peruvian State, through the Sunat, obtained a resolution from the Judiciary that definitively rules in its favor and provides for the execution of letters of guarantee. for the payment of the tax debt, corresponding to a controversy over the Income Tax for the periods 2000 and 2001.

“Let me explain the process a little here. Sunat makes a resolution to determine the debt, the taxpayer may agree or not. If he does not agree, he has to go to the Tax Court and if the taxpayer does not agree with the ruling of the Tax Court, he goes to the Judiciary, but to go to the Judiciary he has to post a bond,” explained José Arista.

“That is what has happened in the case of Telefónica, after 20 years (the process ended), look at how long the justice is, because it went through the Tax Court and the Judiciary,” he added.

A few weeks ago, Telefónica del Perú reported that it will proceed to pay 1,361 million soles (US$ 357 million) to Sunat, in compliance with what was ultimately resolved by the Judiciary for the declaration of Income Tax for fiscal years. from 2000 and 2001.

ACCELERATE PROCESSES

The minister maintained that, taking this case of Telefónica de Perú as a reference, the Peruvian State has managed to advance in several aspects related to tax controversies.

“First of all, as we have seen that the processes are long in the judicial process, thanks to the collaboration of the president of the Judiciary, we have installed exclusive rooms to resolve tax issues,” he stated.

“In this way, the deadline and time for resolution of those taxpayers who do not agree with the ruling of the Tax Court go to the Judiciary and the final ruling is made much more expeditious,” he added.

However, José Arista acknowledged that there has still not been much progress in the jurisdiction of the Tax Court because there are still delays in the processes.

“There I find that the delay times for resolutions are still 5 to 7 years. “It is a very long period,” he said.

“What we are doing now is adding more people, technology and artificial intelligence, changing locations, putting digital records. Our goal is to resolve these files, not in 5 or 7 years, but in one year. “That is what we aspire to in the end,” he said.
