Peru: Indecopi investigates imports of Chinese closures for alleged evasion of antidumping payments

These rights were established to combat unfair trade practices.

The Dumping, Subsidies and Elimination of Non-Tariff Trade Barriers Commission of the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) initiated an examination procedure on the antidumping duties imposed on Peruvian imports of zipper closures originating in China.

This, after identifying alleged practices of evading the payment of such duties, established in 2021, to combat unfair trade practices that affect national production and economy.

Through a Resolution of Indecopi, the Commission indicated that there are reasonable indications of a change in the commercial route of imports of Chinese zipper fasteners.

Thus, it has been identified that, after the imposition of antidumping duties, imports of said product have been registered declaring Indonesia and Thailand as countries of origin, thus evading payment. Previously, the use of this same method was also detected when declaring Taiwan and Malaysia as the origin; however, Indecopi imposed the corresponding corrective measures.

In this regard, between the period of the first half of 2023 and the first half of 2024, imports of closures and their parts declared as originating in Indonesia and Thailand grew and reached 59% of the total imported volume, when previously, in the second half of 2022, they represented 14%.

Even in the case of Thailand, the declared imports of that origin were made through a company created for the research, development, production, sale and service of solar cells, that is, without any relationship with the textile industry.

PRICES BELOW NORMAL VALUE

Another indication is that the closures are exported to Peru at prices below the normal value established in the original investigation in which the anti-dumping duties that are sought to be circumvented were imposed.

The start of this examination (investigation) procedure is thanks to the application of Law No. 31089, which combats the evasion practices of those imports that seek to evade or avoid the payment of antidumping or compensatory duties imposed to correct distortions in the market, and which harm the national production branch.
