Peru: Indecopi begins review of antidumping expiration of biodiesel imports

According to Indecopi, anti-dumping duties will remain in place while the case is being evaluated.

In Peru, the Dumping, Subsidies and Elimination of Non-Tariff Trade Barriers Commission of the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) has ordered the initiation of a sunset review procedure on antidumping duties applied to imports of pure biodiesel (B100) and blends with more than 50% biodiesel (B50), originating in the United States (US).

This is established by a Resolution of Indecopi, published this Wednesday in the Bulletin of Legal Norms of the Official Gazette El Peruano .

The procedure is initiated following the request submitted by Heaven Petroleum Operators and Axxion Green Energy, and aims to evaluate the continuity of the measures initially imposed by Indecopi in 2010 and extended in 2016 and 2020.

During the evaluation, anti-dumping duties will continue to apply in accordance with the World Trade Organization (WTO) Anti-Dumping Agreement.

Indecopi has notified the aforementioned companies, as well as the United States authorities, of the decision, inviting all parties with a legitimate interest to participate in the process.

Interested parties may present their arguments and evidence within a period of six months from the publication of the resolution in the Official Gazette El Peruano , with the possibility of an extension for three additional months.
