The United States refuses to sanction Ecuadorian shrimp for alleged dumping

The U.S. Department of Commerce has issued final determinations for the subsidy and dumping proceedings involving local companies in the Andean country.

Ecuadorian shrimp will not be sanctioned in the United States, following the end of the investigation initiated by the United States Department of Commerce on October 25, 2023, for the alleged use of subsidies and dumping on shrimp imports to the North American country.

This was reported by the Ministry of Production, Foreign Trade, Investments and Fisheries and the National Chamber of Aquaculture (CNA), which confirmed that the final determinations for both processes were issued on Tuesday, October 22.

United States legislation allows the investigation of the main exporting companies of the countries included in these processes, to which the respective determination is made, while the rest of the exporting companies of that product are assigned a value that results from the average determined for the investigated companies.

In the matter of dumping , the percentage of sanctions determined for the company Santa Priscila reaches 0.48%; for the National Society of Galapagos (Songa) and other companies, 0%.

"In the determination made, since the minimum threshold of 2% was not reached, no additional tariffs will be applied to Ecuadorian shrimp exports, meaning that our country will not be subject to sanctions in this area," the Ministry said.

However, in the determination made for subsidies, additional tariffs will be applied equal to the percentages found in the preliminary determination, which are: Santa Priscila, 3.57%; Songa, 4.41%; other companies, 3.78%.

According to the State portfolio, the investigation exhaustively reviewed the aforementioned companies and twenty-eight public policies implemented by our country. “The relevance of Ecuadorian exports in the international shrimp market, as well as the breadth of policies reviewed by the Department of Commerce, make the result achieved a milestone in public-private cooperation for the defense of exports and the generation of jobs in Ecuador,” the Ministry highlighted.

After the final determinations of both processes were known, José Antonio Camposano, president of the CNA, stated on his X account that “the Department of Commerce correctly confirmed that Ecuador does not dump in the US market.”
